South Africa’s DA Challenges New Racial Hiring Law in Court

2

South Africa’s Democratic Alliance (DA) is heading to court to challenge the recently enacted Employment Equity Amendment Act, which mandates racial targets for management positions in large companies. The law, introduced to address economic disparities rooted in apartheid, allows the South African labor minister to set sector-specific targets to increase the representation of Black, Indian, and Coloured individuals in management-level and professionally qualified roles. The DA argues that the law is unconstitutional and harmful to job creation and investment, causing tensions with its coalition partner, the African National Congress. However, supporters of the policy say it is necessary to correct historic imbalances, especially since white South Africans still dominate top private-sector roles despite being just 7% of the population.
