South African Court Blocks Shell’s Wild Coast Exploration

South Africa’s Constitutional Court has overturned an exploration right that would have allowed Shell and Impact Africa to conduct seismic surveys for oil and gas along the ecologically sensitive Wild Coast. The court found serious flaws in the government’s approval process, including inadequate consultation with affected communities and insufficient consideration of environmental and climate concerns. The ruling ends a legal dispute that began in 2021 and marks the first climate-related case to reach South Africa’s highest court. Its significance extends beyond Shell’s project because the judgment places climate change at the center of environmental decision-making and emphasizes procedural, recognition, distributive, and inter-generational justice. The court also stressed that economic development cannot automatically override environmental protection or constitutional rights. Shell and Impact Africa had invested about $62 million in the project, but the court rejected the idea that commercial expenditure should outweigh community rights. The decision could strengthen future climate litigation across South Africa.
